Kayaking, canoeing, and all water-based recreational activities offered by Trinity Drift Co involve inherent risks and dangers that cannot be eliminated. These activities take place in natural environments where conditions can change rapidly and unpredictably.

• Water-Related Hazards: Drowning, hypothermia, swift currents, changing water levels, submerged or floating debris, rocks, and other natural obstacles

• Weather Conditions: Sudden storms, lightning, high winds, temperature changes, and reduced visibility

• Equipment-Related Risks: Equipment failure, improper use of equipment, or loss of equipment

• Physical Risks: Cuts, bruises, sprains, fractures, head injuries, back injuries, or other bodily harm

• Environmental Hazards: Wildlife encounters, insects, poisonous plants, uneven terrain, and remote locations with limited access to emergency services

• Human Error: Mistakes in judgment by participants, guides, or other individuals

Trinity Drift Co., its owners, employees, agents, guides, and representatives are not liable for any injury, death, property damage, or other loss that may occur during or as a result of your participation in our activities, regardless of whether such injury or loss results from:​

• The inherent risks and dangers of the activity

• The negligence of Trinity Drift Co. or its representatives

• The condition of the equipment provided

• Weather conditions or acts of nature

• The actions of other participants

• Any other cause

You hereby waive, release, and discharge Trinity Drift Co from any and all claims, demands, causes of action, or lawsuits arising from or related to your participation in our activities. This waiver includes claims for:

• Personal injury or death

• Property damage or loss

• Economic losses

• Emotional distress

• Any other damages or losses

This waiver applies to claims that may arise from any cause, including but not limited to negligence, breach of contract, or any other legal theory.

You agree to indemnify and hold harmless Trinity Drift Co from any claims, damages, or expenses (including attorney fees) that may arise from your participation in our activities or your breach of this agreement.

You represent that you are physically and mentally capable of participating in the planned activities and that you have disclosed any medical conditions, medications, or physical limitations that might affect your safety or the safety of others.

This liability disclaimer and waiver constitutes a binding legal agreement. If any portion of this agreement is found to be unenforceable, the remaining portions shall remain in full force and effect.

By participating in Trinity Drift Co. activities, you acknowledge that:

• You understand the inherent risks involved in the activities

• You voluntarily assume all risks associated with participation

• You waive any right to make claims against Trinity Drift Co

• You are at least 18 years of age and legally competent to enter into this agreement

• No oral or written representations have been made to you to induce you to participate other than what is set forth in this document
